This disclaimer applies to the website hotlaps.nl (hereinafter: the “Website”) and all related digital services offered by Hjelte Racing (hereinafter: “Hotlaps”, “we” or “us”). By visiting the Website or using the services offered, you agree to this disclaimer.
2. Content of the Website
Hotlaps continually takes the utmost care with the accuracy and completeness of the information on the Website. Even so, we cannot guarantee that all information is at all times accurate, complete, or up to date. The information shown on the Website may be changed without prior notice.
Hotlaps accepts no liability for any damage of any kind arising from the use or inability to use the Website, or from inaccuracies or incompleteness in the information provided on the Website.
3. Imagery and Content
The photos, videos, and other content made available via the Website are produced by or on behalf of the organizer of the relevant track day event. Hotlaps makes this content available exclusively to verified participants of the event.
The content is provided in the state in which it was delivered by the organizer. Hotlaps makes no warranty as to the quality, completeness, or suitability of the content for any specific purpose. Any defects in image or sound quality, missing or incomplete material, or technical limitations fall outside the control and liability of Hotlaps.
4. Availability of the Website
Hotlaps makes reasonable efforts to keep the Website available 24 hours a day, 7 days a week, but cannot guarantee this. The Website may be temporarily or permanently unavailable as a result of maintenance, technical failures, force majeure, or other circumstances. Hotlaps accepts no liability for damage arising from the temporary or permanent unavailability of the Website.

The Website may contain references or hyperlinks to other websites that fall outside the control of Hotlaps. Hotlaps is not responsible for the content, the operation, or the privacy practices of these external websites. The inclusion of a hyperlink does not imply endorsement of the content of the linked website.
6. Intellectual Property
All intellectual property rights in the Website, including but not limited to the name Hotlaps, the Hotlaps logo, the visual identity, the source code, the database structure, and the overall design, are vested in Hjelte Racing or its licensors.
Copyright in the photos and videos made available via the platform is vested in the maker of the imagery or in the organizer of the relevant event. Hotlaps obtains a licence from the organizer to make this imagery available to verified participants.
The user is permitted to download and store content provided to him or her personally for personal, non-commercial use. For any further distribution, publication, commercial use, or use on social media, the specific terms of the Terms of Use apply.
7. Limitation of Liability
To the extent permitted by law, Hotlaps excludes all liability for direct or indirect damage arising from or in connection with the use of the Website or the content offered on it. Indirect damage includes, among others: lost profits, lost savings, loss of data, immaterial damage, and consequential damage.
The total liability of Hotlaps to the user is in all cases limited to the amount paid by the user directly to Hotlaps in the 12 months prior to the event giving rise to the liability. If the user has not paid any direct fee to Hotlaps, liability is limited to 100 euros.
The limitations of liability in this article do not apply in the case of intent or wilful recklessness on the part of Hotlaps or its directors.
8. Track Day Events
Hotlaps is solely the provider of the digital platform on which content from track day events is offered. Hotlaps is not the organizer of the event itself and is not responsible for the organization, the safety, the conduct, or any consequences of the event. For matters concerning the event itself — such as participation, payment, vehicle-related liability, damage to persons or property during the event — we refer you to the organizer of the relevant event.
9. Changes to This Disclaimer
Hotlaps reserves the right to amend this disclaimer at any time. The most current version is always available at hotlaps.nl/disclaimer. We recommend reviewing this disclaimer regularly.
10. Governing Law and Competent Court
This disclaimer is governed exclusively by Dutch law. Disputes arising from or in connection with this disclaimer are submitted exclusively to the competent court in the district where Hotlaps has its registered office, unless mandatory law designates another court.
